Bike accident may result from driver negligence

As you enjoy your bike ride in town one day, you mull the activities you plan to complete before your day off from work comes to a close. Suddenly, a car strikes you, and you find yourself lying on the ground in pain.

A bike accident can unfortunately lead to serious and even fatal injuries. If your accident was the result of a driver's carelessness, it is within your rights to seek compensation for your injuries.

The duty of drivers and cyclists

Both automobile drivers and cyclists have an obligation to follow traffic rules. In addition, they have a duty to exercise reasonable care when it comes to ensuring their own safety as well as other people's safety on the road. As with other car accident situations, both local laws and state laws govern bicycle accident situations.

What you need to know about negligence in bike accidents

If you decide to seek damages for any injuries you have suffered as a result of an automobile accident, the outcome of your efforts typically depends on a couple of questions. First, did the driver's recklessness or negligence cause your bike accident and thus your injuries? Second, were you negligent in any way that caused or contributed to the crash?

Examples of car driver negligence include blowing through a stop sign, speeding or driving into a bicycle lane. Meanwhile, examples of cyclist negligence include failing to stop at a stop sign, turning suddenly into traffic, or going the wrong way down a one-way road.

The recovery of damages

If the automobile driver is determined to have been negligent and caused your accident, you may receive a monetary damage award if liability is established before the civil court hearing your case. However, if authorities determine that you were negligent, you may not receive damages, or your damage award may be reduced according to your degree of fault in the crash.

If you do end up receiving an award, the compensation may be helpful for addressing medical costs, the loss of wages and other losses tied to your bike accident. It can also help with addressing pain and suffering as well as emotional distress resulting from the collision. Your award cannot undo the events leading to your serious bike accident injuries. However, it may help you to more easily move on from the accident.
