$24 Million Settlement For Family Of Truck Accident Victim
Fort Worth, Texas
Nine months after Jane Bartula died in a fiery chain-reaction freeway crash caused by a tractor-trailer ramming into a row of cars, her family settled a lawsuit against the trucking company for $24 million. It was determined that the truck driver worked longer hours than the law allows. The settlement was one of the largest in a wrongful death lawsuit involving a single fatality in Tarrant County.
According to police and news reports, Bartula’s car was behind a truck pulling a horse trailer and in front of a pickup truck when the vehicles slowed down for construction at Western Center Boulevard in north Fort Worth.
The police report said the driver of an 18-wheeler did not slow down enough and rear-ended the pickup into Bartula’s car. The pickup was pushed out of the way, and the 18-wheeler hit Bartula’s vehicle and the horse trailer.
The settlement was paid by an insurance company for Refrigerated Transport of Dallas, a large trucking company. Attorney Scotty MacLean, along with attorney John Jose, represented Floyd Bartula and his daughters, Angelina Lynn Cox and Rebecca Deann Lucas.
Family Receives $1.625 Million Settlement In Wrongful Death Case
Glen Rose, Texas
The family of Cody Day, a Glen Rose resident, received a $1.625 million settlement in their wrongful death lawsuit.
Mr. Day was a pedestrian and was run over in a parking lot of a Glen Rose nightclub.
The Day family brought the lawsuit against the driver of the truck, Collin Hammett, and the truck’s owner, I.E. Miller Services.
“After protracted litigation we are pleased to bring this matter to a successful conclusion. Cody Day was a great family man and he will be missed,” said Scotty MacLean, the family’s attorney.
$2.75 Million Settlement For Johnson County Man Riding A Motorcycle
A Johnson County man, who was injured while riding a motorcycle, received a $2.75 million settlement as a result of a collision with an energy company’s truck.
The accident happened on CR 1108 near Cleburne. Mr. Wynn, the motorcycle rider, alleged that a truck driver for Black River Production Services failed to yield the right of way while turning into a drilling site.
“We are pleased with the result,” said Mr. Wynn’s attorney, Scotty MacLean. “With the abundance of oil field traffic there are new dangers on our roadways. We hope these companies instruct their drivers to use caution and not put profits over safety.”
$9.9 Million In Damages Awarded To Injured Driver
A federal judge ordered the government to pay $9.9 million to a 14-year-old Missouri woman who suffered permanent brain damage in a 1998 head-on collision with a vehicle driven by a census worker in Denton County. Fort Worth attorney Scotty MacLean filed the lawsuit under the Federal Tort Claims Act because the accident involved a government employee.
The crash occurred when the southbound vehicle of census worker Mikel Kennedy, of Sherman, crossed the center line and slammed into Reagan’s pickup. Kennedy was killed instantly. Reagan suffered permanent brain damage that left her dependent on custodial care for the rest of her life, MacLean said.
An accident reconstructionist for the government testified that Reagan swerved across the center line and then back into her lane, forcing Kennedy to cross into the oncoming lane in an evasive maneuver. But testimony from several eyewitnesses swayed the judge, MacLean said.
$1,163,960 FELA Verdict For Injured Railroad Worker
Tarrant County, Texas
Scotty MacLean, along with attorneys from Tavormina & Young, secured a $1,163,960 judgment on behalf of Ronald Nichols, a BNSF employee who suffered an on-the-job injury. The verdict and judgment were upheld on appeal. The case was brought pursuant to the Federal Employers’ Liability Act (FELA), a law that governs on-the-job injuries to railroad workers.
